Contract Terms

1. Overview
These Contract Terms are the standard terms and conditions that apply to digital service contracts entered into through Jobsy. They are incorporated by reference into every Jobsy contract between a customer (hirer) and a service provider unless the contract expressly overrides a specific clause. These terms are governed by the laws of Jamaica.
2. Parties & capacity
Each party warrants they are at least 18 years old, have the legal capacity to enter a binding contract, and are the account holder under which they are signing. Signing a Jobsy contract electronically has the same legal effect as a handwritten signature under the Electronic Transactions Act of Jamaica.
3. Scope of work
Each contract must describe the scope of work clearly, including deliverables, quality standards, timelines, materials, and location. Changes to scope (variations) must be agreed in writing through the Jobsy platform and will be binding only once both parties confirm.
4. Price & payment
- All prices are in Jamaican Dollars (JMD) unless otherwise stated.
- Payment timing (deposit, milestone, completion) is set by the specific contract.
- Payments are held in escrow by Jobsy where the contract specifies escrow and are released upon milestone completion or contract completion.
- Platform and payment-processing fees are applied as disclosed at checkout.
5. Performance standards
The provider agrees to deliver the work described with reasonable skill and care, in a workmanlike manner, and in compliance with applicable Jamaican laws and industry standards. The customer agrees to provide reasonable access, accurate information, and timely feedback to allow the provider to perform.
6. Timelines & delay
Start and completion dates are set in the specific contract. Delays caused by force-majeure events (natural disaster, civil disruption, utility outage) do not constitute a breach, provided the affected party notifies the other within 72 hours and uses reasonable efforts to mitigate.
7. Cancellation
- Either party may cancel before work begins per the Jobsy Refund Policy.
- Cancellation after work starts entitles the provider to reasonable compensation for work completed and non-recoverable costs already incurred.
- Repeated cancellations by either party may affect their Jobsy reputation and account standing.
8. Warranties
The provider warrants that materials supplied are fit for purpose and free from defects at delivery. Workmanship warranties (where offered) are stated in the specific contract and default to 30 days unless otherwise agreed. Statutory consumer rights under Jamaican law are not affected by this clause.
9. Liability
Neither party is liable to the other for indirect, consequential, or incidental damages (including lost profits or loss of data) arising out of the contract. Each party's total liability is capped at the total contract value, except in cases of fraud, gross negligence, or death/personal injury, where statutory limits apply.
10. Insurance
Providers whose trade requires insurance (e.g. electricians, plumbers, drivers) warrant that they hold current policies appropriate to the work. Proof of cover may be requested before work begins.
11. Confidentiality
Each party agrees to keep confidential any non-public information received from the other during the contract, except where disclosure is required by law or with the other's consent.
12. Disputes
Disputes are handled through Jobsy's internal dispute-resolution process in the first instance. If the internal process does not resolve the dispute, the parties agree to attempt mediation before pursuing litigation. All litigation is subject to the jurisdiction of the courts of Jamaica.
13. Severability & entire agreement
If any clause of these terms or the specific contract is held unenforceable, the rest remain in force. These Contract Terms, together with the specific contract signed through Jobsy and the Jobsy Terms of Service, form the entire agreement between the parties and supersede any prior oral or written understandings.
